General Agreement on Trade in Services (GATS) Work Permits

The GATS agreement makes it easier for foreign business workers from designated countries to enter Canada without the need for a Labour Market Impact Assessment.

You can apply before entering Canada or at a Canadian port of entry as the following:

  • Business Visitor
  • Professional
  • Intra-Company Transferees
If you are a business visitor representing a company in your home country, you may come to Canada without a work permit.

You may qualify if:

  • you intend to market or establish a commercial presence of your company in Canada
  • your main source of income and profits remains outside of Canada
  • you meet Canada’s basic entry requirements
If you work in a Country that is a member of GATS for a company which has a presence in Canada, and you have worked for that company for at least one year in the last three years, you may be eligible.

You may qualify if:

  • you are seeking entry following a signed contract between the foreign company and the Canadian consumer
  • you meet the necessary academic credentials and qualifications
  • you meet Canada’s basic entry requirements

You can only stay for a maximum of 90 days in Canada for every 12-month period.

If you have a managerial or executive role in a company and intend to transfer to the Canadian affiliate, branch or subsidiary of that company, you may be eligible to apply.

The intra-company category was established to allow overseas companies to transfer key employees to Canada on a temporary basis. These employees should possess skills and experience to improve management and enhance the competitiveness of Canadian markets.

You may qualify if:

  • You have worked for the same company for at least one year within three years
  • you have worked as a manager, executive, or in a position that uses specialized knowledge
  • you meet Canada’s basic entry requirements
